古代法律形式。通過(guò)國(guó)家正式立法程序制定、頒布、實(shí)施的法律文件,具有穩(wěn)定性、規(guī)范性和普遍性的特點(diǎn)。從源流上來(lái)看,“律”具有“法律”“法令”含義,至晚不會(huì)遲于商。戰(zhàn)國(guó)商鞅改“法”為“律”后,使之成為法典名稱(chēng)。除宋、元兩代外,中國(guó)歷代均稱(chēng)法典為“律”?!奥伞笔枪糯罨?、最重要的法律形式。
